Peak, operating as Alpha Fire Mindset ("Company," "we," "us," or "our"), governing your access to and use of the Alpha Fire Mindset platform, website, mobile application, and all associated services (collectively, the "Service").

By creating an account, accessing the Service, or clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Alpha Fire Mindset is a personal development and sales coaching platform that provides:

• NLP-powered daily mindset prompts across five personal development pillars
• AI-assisted sales coaching and scenario practice
• Habit tracking with streak monitoring and completion history
• Goal setting and milestone tracking across multiple life categories
• Journaling with mood tracking and search functionality
• Personality assessment and compatibility guides (APEX framework)
• Voice input and transcription for hands-free journaling
• Educational content library based on Jay J.P. Peak's published works
• One-on-one coaching and business consulting inquiry services

The Service is provided for personal and professional development purposes only. It does not constitute licensed therapy, medical advice, financial advice, or legal advice.

3. Eligibility

To use the Service, you must be at least 18 years of age. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding agreement. The Service is not available to users who have been previously suspended or removed from the platform.

To access certain features of the Service, you must create an account. You agree to:

• We are not responsible for outcomes resulting from your reliance on AI-generated content

In no event shall our total liability to you exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

You agree to indemnify, defend, and hold harmless Jay J.P. Peak, Alpha Fire Mindset, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to violation of these Terms, fraudulent activity, or conduct harmful to other users or the platform.

You may terminate your account at any time by contacting us at [email protected]. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in Dallas, Texas, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Alpha Fire Mindset.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email and/or prominent notice on the platform. Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

17. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and Alpha Fire Mindset regarding the Service and supersede all prior agreements and understandings.
